These terms and conditions are applied on behalf of YOAR.MUSE Hair Wear by Yara & Romee.

ARTICLE 1. APPLICABILITY
1.1 These terms and conditions apply to all offers, orders and agreements of YOAR.MUSE.
1.2 By placing an order, the buyer accepts the applicability of the applicable conditions.
1.3 YOAR.MUSE may change the terms and conditions at any time.
1.4 Deviations from these terms and conditions are only possible with the written approval of YOAR.MUSE.
1.5 All rights and claims also apply to third parties engaged by YOAR.MUSE.
ARTICLE 2. OFFERS AND AGREEMENTS
2.1 All offers from YOAR.MUSE are without obligation and may change.
2.2 YOAR.MUSE reserves the right to change packaging, contents, models and colors.
2.3 An agreement is only concluded after YOAR.MUSE accepts the order. YOAR.MUSE may refuse orders without giving reasons and will notify you of this within 5 business days.
ARTICLE 3. DELIVERY AND SHIPPING
3.1 The shipping method is determined by YOAR.MUSE, unless otherwise agreed.
3.2 YOAR.MUSE is not liable for delays at the distributor's premises.
3.3 Delivery times are approximate and YOAR.MUSE is not liable for any costs or damages if they are exceeded.
3.4 Damage during transport upon delivery will be reimbursed provided there is clear evidence and the shipment was sent with an additional service.
3.5 Products that are out of stock will not be automatically shipped; the buyer will be notified within 5 business days and can cancel the order.
ARTICLE 4. PRICES
4.1 Prices are in euros, excluding 21% VAT and shipping costs.
4.2 For deliveries outside the Netherlands, the regular postal rates apply.
4.3 YOAR.MUSE reserves the right to change prices.
ARTICLE 5. TECHNOLOGY
5.1 The hair must be applied according to the method taught by YOAR.MUSE.
5.2 YOAR.MUSE offers training for application if desired.
5.3 The buyer may use the technique as long as the hair is purchased from YOAR.MUSE.
ARTICLE 6. PAYMENTS
6.1 Invoices must be paid within fourteen (14) days of receipt.
6.2 If payment is not received, you will receive an initial payment reminder requesting you to make payment as soon as possible, but urgently. This reminder will expire after (10) ten days.
6.3 If payment is not received despite receiving a payment reminder, you will receive a second payment reminder requesting you to make payment as soon as possible, but urgently. This reminder will expire after (5) five days.
6.4 If payment is not received despite the two payment reminders, you will receive a third payment reminder requesting you to make payment as soon as possible, but urgently. This reminder expires after (5) five days.
6.5 If payment is not made after 3 payment reminders, we will hand the claim over to a debt collection agency and charge the statutory collection costs.
ARTICLE 7. WARRANTY AND EXCHANGES
7.1 Goods can be exchanged within fourteen (14) days of the invoice date, provided the packaging seal is not broken, damaged, resealed, etc. The customer is aware that hair products fall under the cosmetics group and, for hygiene reasons, do not need to be accepted by YOAR.MUSE for exchange if the packaging is broken, damaged, resealed, etc.
7.2 YOAR.MUSE will only refund money if article 7.1 is met.
7.3 (Shipping) Costs incurred to exchange goods are borne by the buyer.
7.4 Returning items without registered mail is at your own risk.
7.5 The buyer is obligated to check whether the delivered items correspond to the order. Any deviations in color, texture, and/or model, insofar as acceptable, cannot be returned or exchanged. If this is not the case, the buyer must report this by email to YOAR.MUSE within seven (7) days of delivery, stating the buyer's name, the order number, and a clear explanation of why the item does not meet the requirements. YOAR.MUSE will replace the item or refund the payment if it is demonstrated that the item is not accepted for valid reasons. If no defect is reported within this period, any claim against YOAR.MUSE regarding any defect will lapse.
7.6 Photos of products on the YOAR.MUSE website are for illustrative purposes only; no rights can be derived from them. Customers are aware that hair is a natural product and that products may sometimes vary slightly.
7.7 YOAR.MUSE can never be held responsible for damages incurred due to incorrect (return) shipments with incorrect items.
7.8 YOAR.MUSE does not exchange products and/or refund money on used goods that are in good condition.
7.9 A return shipment will only be exchanged once it has been received by YOAR.MUSE
and has been approved.
ARTICLE 8. MAINTENANCE AND COMPLAINTS
8.1 Hair is a natural product, derived from humans, and therefore, if used improperly, it may become frizzy or dry. The buyer must be aware of this and handle the products appropriately.
8.2 The buyer must inform his/her consumer how to treat the hair.
8.3. If the quality significantly deteriorates after using the correct care, products, and maintenance advice, please notify us by email at info@yoarmuse.nl. YOAR.MUSE would like to receive the hair within seven (7) days of receiving the email and will assess the product and replace it if necessary.
8.3 The buyer cannot invoke this warranty if:
- A. The hair extensions were applied by third parties
- B. The hair extensions have been used improperly/or the maintenance advice has not been followed
- C. Changes have been made by or on behalf of the buyer (painting, bleaching, etc.).
- D. damage caused intentionally or through gross negligence
8.4 Complaints about quality must be submitted by email to info@yoarmuse.nl within thirty (30) days of purchase, clearly explaining the complaint. If no defect is reported within this period, any claim against YOAR.MUSE will be forfeited.
8.5 YOAR.MUSE will only handle complaints from official buyers (as recorded in the customer database and stated on the invoice).
8.6 The buyer is obliged to provide all cooperation necessary to resolve the complaint in all reasonableness.
8.7 If any doubt arises about the product during treatment, treatment should be stopped immediately and YOAR.MUSE should be contacted.
8.8 Products that have already been chemically treated are not eligible for complaint handling.
8.9 Chemical treatment (e.g. dyeing, perming, etc.) of the hair is at the buyer's own risk.
8.10 YOAR.MUSE does not provide any warranty for improper use/care of the hair extensions. Coloring the hair extensions with silver shampoo or other color-changing products is at your own risk.
8.11 YOAR.MUSE does not provide any warranty for incorrect color choices made by the customer.
8.12 YOAR.MUSE does not provide any guarantees regarding the manner in which the hair extensions are applied and if the client does not experience this as pleasant.
8.13 When using heat tools (with a maximum temperature of 180 degrees), always use tools (e.g., a hair straightener) with ceramic plates. Also, always blow-dry your hair only with ceramic brushes. When using other tools (e.g., iron or aluminum tools), YOAR.MUSE is not liable for any damage resulting from use.
8.14 YOAR.MUSE is not liable for the work of third parties.
8.15 Cutting the hair extensions shorter is at your own risk.
8.16 Cutting hair extensions is at your own risk. This voids the guarantee against hair loss.
8.17 Return shipment does not guarantee reimbursement.
8.18 The customer is expected to take his/her own responsibility if a problem arises (e.g. by not following the guidelines that apply to hair extensions) for which YOAR.MUSE is not at fault.
8.19 The customer is expected to submit a complaint honestly. If the facts are distorted, YOAR.MUSE cannot process the complaint.
8.20 YOAR.MUSE is entitled to no longer supply its products to customers who are not acting in good faith.
8.21 A refund consists solely of a product identical to the purchased product and does not include reimbursement of money or costs incurred to third parties. If a product is out of stock, a credit note will be issued for the same value as the purchased product.
8.22 No correspondence will be entered into regarding rejected complaints.
ARTICLE 9. RETURNS

9.2 Products must be returned within 7 days.
9.3 Seal must not be broken.
9.4 Return shipping costs are for the buyer unless YOAR.MUSE has made an incorrect delivery.
9.5 Returns that are not sent by registered mail are at the buyer's risk.
9.6 YOAR.MUSE is not responsible for the loss or delay of a return shipment.
9.7 Insufficiently stamped or unstamped returns will not be accepted by YOAR.MUSE.
ARTICLE 10. INDEMNIFICATION
10.1 Buyer indemnifies YOAR.MUSE against liability towards third parties.
10.2 YOAR.MUSE is not liable for damage caused by hair extensions
10.3 Use of hair extensions is at your own risk.
ARTICLE 11. JURISDICTION
In case of disputes, the court of the place of business of YOAR.MUSE has jurisdiction.
ARTICLE 13. RESERVATION OF OWNERSHIP
Delivered goods remain the property of YOAR.MUSE until full payment has been received.
